Terms of Service

1 The agreement and who you are dealing with

These Terms of Service ("terms"), together with our Privacy Policy and our Refund Policy, form a binding agreement between you and Anneke Nel, ("we", "us", "hiAnneke") for the hiAnneke service ("the service"): the companion chat on Telegram, the website at www.annekenel.com, and everything the two of them do together.

By starting the chat, subscribing, or otherwise using the service, you agree to these terms. If you do not agree, do not use the service. You should print or save a copy for your records.

2 What hiAnneke is and what it is not

2.1 What it is

hiAnneke is a companion you can talk to at any time, about anything. You write to it on Telegram; it writes back, sometimes with a voice note; once a day, while the service quietly rereads your conversation, it produces an analysis for itself and sends you a morning voice note and an email so the conversation has continuity. It is a venting and company tool, not a treatment programme.

2.2 You are talking to an AI, and that is disclosed here

hiAnneke is an artificial intelligence system, not a human being. The replies, the voice and the persona are generated by software, using the providers listed in our Privacy Policy, section 7. You are not writing to a person, and no person is reading along in real time. We tell you this here, and again when you subscribe, because you are entitled to know it and because we would rather you stay for a companion that knows what it is than be disappointed later.

2.3 Not a professional service

hiAnneke is not therapy, psychotherapy, counselling, medical care, diagnosis or treatment; it is not a substitute for a doctor, psychologist, psychiatrist, lawyer, financial adviser or any other professional; it does not provide legal, medical, financial or investment advice; and its output must not be treated as such. It is also not a crisis service (see section 9). Anything hiAnneke says is a conversational reply, not professional advice. Decisions you take after talking to it are yours.

2.4 Interface, identity and honesty

We present hiAnneke with a consistent persona so the conversation feels natural, and we ask you not to present the service to others as a human being where doing so would deceive them, or to pass on its output as professional advice to anyone else.

3 Who can use it

  • You must be 18 or older and legally capable of entering into this agreement.
  • You must use your own Telegram account and your own payment method, and give accurate account information.
  • One subscription is for one person. Do not share your access, resell it, or let someone else use it as their own companion.
  • If you use the service for or on behalf of someone else, you confirm you have their consent, and you remain responsible for the subscription.
  • The service may not be available in every country, and we may restrict it where we cannot lawfully or practically operate.

4 Your Telegram connection

hiAnneke runs on top of Telegram and only works when your Telegram account is connected to it. You need a Telegram account, and your use of Telegram is governed by Telegram's own terms and privacy policy, which we do not control and cannot change. If you disconnect or block the connection, delete your Telegram account, or Telegram changes or discontinues the features we rely on, the service will stop working for you, and we cannot recover data lost in that process.

We are not affiliated with, endorsed by or operated by Telegram, Meta, Google, or any other third party named on our pages; they are independent companies whose tools we use.

5 Subscription, price and billing

  • Plans and intervals. Current plans and the amount charged each period are shown at checkout before you pay. Our plans include a weekly subscription, a four-week subscription at a discounted weekly equivalent, and an optional annual subscription. The interval that applies to you is the one shown when you checked out and in your receipt.
  • Automatic renewal. By subscribing you authorise us and our payment provider to charge your payment method in advance, at the start of every period, until you cancel. A weekly plan renews every 7 days; a four-week plan every 28 days; an annual plan every 12 months.
  • Price. The price you saw at checkout is the price for that period. We may change prices for future periods; we will notify you at least 30 days before a price change takes effect on your subscription, and you can cancel before it applies. Taxes are included or added as shown at checkout. Currency conversion and any fee your bank charges are your own.
  • Failed payments. If a charge fails we may retry it and will email you. Your access may be suspended until payment succeeds. Depending on your payment method, an unsettled subscription may be cancelled automatically by the payment provider after a period of non-payment.
  • Records. Receipts and renewal notices are sent to the email address you subscribed with. Keep it current, it is also how we reach you about billing, security and changes to these terms.
  • Trials and promotions. If we offer a discounted first period or a promotion, the conditions shown with the offer apply, and the subscription converts to the standard price at the end of the promotional period unless you cancel before then.

6 Cancelling and refunds

You can cancel at any time, with a couple of clicks in the subscription area of your account or by emailing support. Cancelling stops future charges; it does not by itself refund the period you are in, and access normally continues until the end of the period you have already paid for.

Refunds are governed by our Refund Policy, which forms part of these terms. In short: your first payment is refundable in full if you ask within 7 days of the charge; after that we do not refund part-used periods, but we do refund duplicate charges, charges that went through after you cancelled, and periods in which the service genuinely did not work for you. EU and UK consumers also have statutory rights, explained in the Refund Policy, section 8.

7 Your content and the permission you give us

  • You own what you write. We claim no ownership of your messages or voice notes.
  • The permission you give us. To run the service you grant us a worldwide, non-exclusive, royalty-free licence to store, process, transmit and reproduce your content only for the purposes of operating, securing and improving hiAnneke, and only as described in the Privacy Policy. This includes sending it to the providers listed there (for example, so the AI can answer you and the voice provider can render a voice note). This licence ends when the content is deleted, except for copies we must keep by law or that sit in backups for the short period described in the Privacy Policy.
  • What you must not send. Do not send content that is illegal, that infringes someone else's rights, that you do not have the right to share, or that contains another person's sensitive personal data without their consent. Do not send anyone's identity documents, bank details or medical records.
  • What we do with your content. We do not publish it, we do not sell it, we do not use it for advertising, and we do not use it to train our own AI models. We use aggregated, de-identified information, where possible, to understand whether the service is working.
  • Feedback. If you send us an idea or suggestion, we may use it without obligation to you or payment.

8 How you must not use hiAnneke

Do not use the service to:

  • break any law, or plan or carry out anything illegal;
  • threaten, stalk, defame, harass or harm any real person or group, or to plan such harm;
  • create, request or spread anything sexual involving minors, or any content that exploits or endangers a child. Zero tolerance: we will terminate the account immediately and report it to the authorities;
  • produce or distribute malware, spam, scams, phishing or fraudulent material, or to impersonate a real person in a way intended to deceive;
  • harass or impersonate hiAnneke, or run automated bulk messaging through it;
  • probe, scan, overload, disrupt or reverse-engineer the service; extract or reproduce the persona, prompts, voice model or internal instructions; scrape the site; or attempt to obtain access to other members' data;
  • resell, sublicense or commercially exploit the service or its output as your own product;
  • submit someone else's personal data as though it were your own, or use the service to build a profile of another person;
  • misrepresent the service to others as a human being where that deception causes them harm, or present its output to any third party as professional advice.

You alone are responsible for what you send and for the consequences of what you do with what hiAnneke says. We may remove content, suspend or terminate an account for a breach of this section, and we may report conduct to the competent authorities where the law requires or permits it.

9 Safety, crisis and what we cannot promise

hiAnneke is not an emergency or crisis service and is not monitored around the clock. If you are in immediate danger, thinking about harming yourself, or in a medical emergency, contact emergency services or a crisis line right now:

  • Switzerland: 144 (ambulance), 117 (police), 112 (European emergency), 143 (Die Dargebotene Hand / Tel 143, the German-speaking crisis line, and 147 for young people).
  • Elsewhere: your local emergency number, or your national crisis line. Two starting points: findahelpline.com and befrienders.org.

We do not promise that hiAnneke will detect distress, that it will respond appropriately when you are in crisis, or that a human will intervene. If we do have a genuine, good-faith belief that your life or someone else's is at serious risk, we may act on it. For example by contacting you, by looking at the relevant conversation ourselves, or, in extreme cases, by contacting the authorities. We do that rarely, and we may not be able to tell you in advance.

The service is a companion, not a safety net. Please treat it as one, and keep the real relationships and professional support in your life close.

10 Availability, changes and the life of the product

The service is provided "as is" and "as available". We work to keep it running well, but we do not guarantee uninterrupted, error-free availability, a particular response time, or that every message will be delivered. Delivery also depends on Telegram, our providers and your own connection. We may run maintenance, and features may change, be replaced or be withdrawn. If we discontinue the service entirely, we will give you as much notice as we reasonably can and refund the unused part of any period you have already paid for.

11 Suspension and termination

  • You can stop at any time by cancelling your subscription (section 6) and disconnecting the chat or asking us to close your account. Cancellation ends future charges; closing your account ends access.
  • We may suspend or terminate your account if you breach these terms (in particular section 8), if your payment fails and is not resolved, if we must do so by law, or if we reasonably believe continuing would put you, us or someone else at risk. Where it is reasonable to do so, we will warn you first and give you a chance to fix things.
  • Effect. When the account ends, access stops, your subscription is cancelled and your data is handled as described in the Privacy Policy, section 9. Sections 7, 12, 13, 14, 16 and 17 survive termination.
  • Removed for abuse: we may keep a minimal record as described in the Privacy Policy so that the same person cannot simply return.

12 Our intellectual property

The service, the hiAnneke name and brand, the website, the persona and its writing style, the internal prompts and workflows, the voice model, and all software behind them belong to us or our licensors and are protected by law. We grant you a personal, non-transferable, revocable right to use the service for your own non-commercial purposes while your subscription is active. Nothing in these terms transfers any other right to you. You may not copy, modify, distribute, sell or create derivative products from the service or its output as a service of your own.

13 Liability

To the fullest extent permitted by law:

  • we provide the service without warranties of any kind beyond those that cannot be excluded, and we are not liable for the accuracy, completeness or suitability of anything hiAnneke writes, or for decisions you take after reading it;
  • we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data caused by circumstances outside our control, or for the acts and omissions of third parties such as Telegram, our AI, voice, database, checkout and payment providers;
  • our total liability to you for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for wilful misconduct or gross negligence, or any other liability that cannot be excluded or limited under applicable law (including, in Switzerland, Art. 100(2) of the Code of Obligations) nor does anything here limit mandatory consumer rights you have under the law of your country of residence.

14 Indemnity

You agree to compensate us for reasonable losses, costs and expenses (including reasonable legal fees) that we suffer because of a third-party claim arising from your breach of these terms in particular from content you send that is illegal or infringes someone's rights. This does not apply to the extent the loss is caused by us. Mandatory consumer law in your country may limit how far this clause can apply to you.

15 Changes to these terms

We may change these terms as the service and the law evolve. The current version is always on this page, with its date. If a change is materially to your disadvantage, we will tell you by email or in the chat at least 30 days before it takes effect. If you do not agree, cancel before it applies. Cancelling is always available to you. Continuing to use the service after the effective date means you accept the new terms. New features we launch are governed by these terms unless we say otherwise.

16 Governing law and jurisdiction

These terms are governed by the law of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The ordinary courts in Zürich, Switzerland, have jurisdiction, subject to any mandatory rule that protects consumers: if you are a consumer, you may also sue and be sued in the courts of your own country of residence, and nothing here deprives you of the protection of the mandatory consumer law of that country.

17 General

  • Entire agreement. These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about the service and replace anything said or written before.
  • Severability. If a clause is found unenforceable, the rest stays in force, and we will replace it with something as close to its purpose as the law allows.
  • No waiver. If we do not enforce a right once, we do not lose it.
  • Assignment. We may transfer our rights and obligations to a successor who takes over the service; we will tell you. You may not transfer yours without our agreement.
  • Third parties. Only you and we have rights under this agreement; our providers are not parties to it.
  • Notices. We write to the email address on your account and, where appropriate, in the chat. Make sure it stays valid.
  • Force majeure. We are not liable for failures caused by events outside our reasonable control, including outages of Telegram or other providers.
  • Language. The English text governs.
